1. Introduction & Commitment

IPTV Kastje (“iptvkastjekopen.com”) is committed to complying with copyright and related intellectual property laws. We respect the intellectual property rights of others and expect our users to do the same. This policy outlines our procedures for responding to allegations of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 (DMCA), Title 17, United States Code, Section 512, the EU Copyright Directive 2019/790, and other applicable international copyright treaties and conventions.

As a service provider, IPTV Kastje qualifies for safe harbor protection under 17 U.S.C. § 512. We have adopted and reasonably implemented a policy that provides for the termination, in appropriate circumstances, of users and account holders who are repeat infringers.

2. Our Service

IPTV Kastje operates as a technology platform and does not host, produce, or control third-party content. All media, streams, and content accessible through our service are provided by independent third-party sources and content delivery networks. IPTV Kastje acts as an intermediary technology service provider and does not assume responsibility for the content, accuracy, or legality of any third-party material.

3. DMCA Compliance (17 U.S.C. § 512)

In compliance with the DMCA, IPTV Kastje will respond expeditiously to claims of copyright infringement committed using our service that are reported to our Designated Copyright Agent. Upon receipt of a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly;
  • Notify the content provider, member, or user that the material has been removed or access has been disabled;
  • Provide the content provider, member, or user with information regarding counter-notification procedures;
  • Terminate, in appropriate circumstances, subscribers and account holders who are repeat infringers.

4. Filing a DMCA Takedown Notice

If you are a copyright owner or authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

Required Elements (17 U.S.C. § 512(c)(3))

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit IPTV Kastje to locate the material (e.g., the specific URL or page where the content appears);
  4. Contact information of the complaining party, including name, address, telephone number, and email address;
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Content Removal Timeline

Upon receipt of a valid and complete DMCA takedown notice, IPTV Kastje will follow this process:

7. Counter-Notification Procedure

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification pursuant to 17 U.S.C. § 512(g). To be effective, a counter-notification must be a written communication provided to our Designated Copyright Agent that includes the following:

Required Elements for Counter-Notification

  1. Physical or electronic signature of the subscriber;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the subscriber’s address is located (or, if outside the United States, any judicial district in which IPTV Kastje may be found), and that the subscriber will accept service of process from the person who provided the original notification or an agent of such person.

Upon receipt of a valid counter-notification, IPTV Kastje will promptly provide the original complaining party with a copy of the counter-notification. The original complaining party then has ten (10) business days to file a court action seeking to restrain the subscriber from engaging in infringing activity relating to the material. If IPTV Kastje does not receive notice of such a court action within the specified period, we may, in our discretion, restore the removed material or cease disabling access to it.

8. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, IPTV Kastje has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users or account holders who are deemed to be repeat infringers. IPTV Kastje may also, at its sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

9. Good Faith & Misrepresentation Warning

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability. This includes damages, costs, and attorneys’ fees. Before filing a DMCA notice or counter-notification, you may wish to contact an attorney to better understand your rights and obligations under the DMCA and other applicable laws.

Please also be advised that we will forward the complete DMCA notification, including your personal information, to the party that posted the allegedly infringing content, in accordance with our legal obligations.

10. Accommodation of Standard Technical Measures

IPTV Kastje accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined in 17 U.S.C. § 512(i)(2). These measures include technologies that are developed pursuant to a broad consensus of copyright owners and service providers in an open, fair, voluntary, multi-industry standards process, are available to any person on reasonable and nondiscriminatory terms, and do not impose substantial costs on service providers or substantial burdens on their systems or networks.

11. Third-Party Content Disclaimer

IPTV Kastje does not host, upload, store, or transmit any copyrighted content on its servers. Our service provides access to third-party content that is freely available on the internet through publicly accessible APIs, streams, and content delivery networks. IPTV Kastje does not control, curate, or modify the content provided by third-party sources. Any content accessible through our platform is the sole responsibility of the third-party provider.

The presence of any content on or accessible through our service does not imply endorsement, authorization, or affiliation with IPTV Kastje. We make no representations or warranties regarding the accuracy, legality, or availability of any third-party content.

12. Safe Harbor Statement

IPTV Kastje operates as a service provider as defined by the DMCA and qualifies for safe harbor protection under 17 U.S.C. § 512(a)-(d). Specifically:

  • Transitory Digital Network Communications (§ 512(a)): We transmit, route, or provide connections for material through our system at the direction of users, without modification to the content.
  • System Caching (§ 512(b)): Any intermediate and temporary storage of material is carried out through an automatic technical process.
  • Information Residing on Systems at Direction of Users (§ 512(c)): We do not have actual knowledge that the material on our system is infringing; we are not aware of facts or circumstances from which infringing activity is apparent; and we act expeditiously to remove or disable access to the material upon obtaining such knowledge or awareness.
  • Information Location Tools (§ 512(d)): We do not have actual knowledge that linked-to material is infringing; we act expeditiously to remove or disable the link upon obtaining such knowledge.

We do not receive a financial benefit directly attributable to the infringing activity where we have the right and ability to control such activity.

13. International Copyright Compliance

In addition to DMCA compliance, IPTV Kastje respects international copyright laws and treaties, including but not limited to:

  • EU Copyright Directive 2019/790 (DSM Directive) — including Article 17 regarding online content-sharing service provider liability;
  • EU E-Commerce Directive 2000/31/EC — Articles 12-15 regarding intermediary liability and the prohibition on general monitoring obligations;
  • Berne Convention for the Protection of Literary and Artistic Works;
  • WIPO Copyright Treaty (WCT) and WIPO Performances and Phonograms Treaty (WPPT);
  • TRIPS Agreement (Agreement on Trade-Related Aspects of Intellectual Property Rights);
  • UK Copyright, Designs and Patents Act 1988 (CDPA);
  • Canadian Copyright Act (R.S.C., 1985, c. C-42), including the notice-and-notice regime.

Copyright holders from any jurisdiction may submit takedown requests using the procedure outlined in Section 4 above. We will process all legitimate requests regardless of the claimant’s country of origin.

14. User Obligations

By using IPTV Kastje’s services, you represent and warrant that:

  • You will not use the service to infringe or violate any third party’s intellectual property rights;
  • You will not upload, distribute, or transmit any content for which you do not have the necessary rights, licenses, or permissions;
  • You understand and accept that IPTV Kastje may remove any content or terminate your access at any time for violation of this policy;
  • You acknowledge that IPTV Kastje may cooperate with law enforcement and provide user information when compelled by valid legal process.

15. Limitation of Liability

IPTV Kastje shall not be liable for any damages arising from or related to:

  • The removal or disabling of access to any content pursuant to a DMCA takedown notice;
  • The failure to remove or disable access to any content claimed to be infringing;
  • Any third-party claims arising from any user’s use of the service;
  • Any action taken by IPTV Kastje in good faith compliance with this DMCA policy or applicable copyright law.

16. Modifications to This Policy

IPTV Kastje reserves the right to modify, amend, or update this DMCA Policy at any time, with or without notice. Any changes will be effective immediately upon posting the updated policy on this page. Your continued use of our services following the posting of changes constitutes your acceptance of such changes. We encourage you to review this policy periodically for any updates.
